Driver bags 3 count charges

Momodou L. Touray, a commercial vehicle driver, was arraigned before Magistrate BO Jobe of the Bundung Magistrates Court, charged on three counts.

On count one of his offences, the accused, on 10 April, 2008, near the Tabokoto traffic lights,  drove a motor vehicle with registration number BJL 1592 E, without due care and attention, thereby causing an accident.

On count two, the accused, on the same day and in the same environment, reportedly drove the said motor vehicle and carried 18 passengers, with an excess of 4 passengers, while his driving license was Group C, 14 passengers. And the third count stated that the accused drove the same commercial vehicle without a valid certificate of insurance for the motor vehicle.

After reading the statement of offense, the accused pleaded not guilty to the three charges pressed against him. The presiding magistrate subsequently granted him bail in the sum of D5000 or a Gambian surety with the same amount, and the case was adjourned to September 25, 2008, for continuation of the proceeding.

In a similar development, another commercial vehicle driver, Assan Jallow, was charged on two counts: count one for allegedly causing an accident on 8 December, 2007, along Latrikunda Cow Junction, in the KMC. He was said to have driven a commercial van with registration number BJL 9179 B, without due care and attention.

And on count two, Mr Jallow was accused of carrying 14 passengers even though his driving license was Group C, 4 passengers. He pleaded guilty to both charges.
The case was adjourned to 29 September, 2008, for the prosecutor to present the facts of the case. Meanwhile, the accused was granted bail in the sum of D3,000 or a Gambian surety with the same amount.
