Lawyer Ousainou Darboe yesterday testified before Magistrate Pa Harry Jammeh of the Kanifing Magistrates’ Court in an ongoing case to decide the ownership of Lama Lama Bar and Restaurant.
In his testimony, Mr Darboe affirmed that he knew both the defendant, Mamadi Keita, and the plaintiff, a Briton named Brian Peters who earlier filed a lawsuit against the defendant for allegedly claiming shares unlawfully in the partnership deed of Lama Lama Bar and Restaurant.
According to Mr. Darboe, his friend, Dr. Boro Suso, once called him to request for his advice on business partnership involving Lama Lama Bar & Restaurant. He further said that Mamadi Baba Keita, Brian Peters and Susan Brown visited him at his house at number 57 Kairaba Avenue to inform him on the nature of the problem in a bid to seek his advice on partnership registration. However, Mr. Darboe continued, neither of the litigants had the deed. “I later told them I cannot give any advice until I see the partnership deed,” Mr. Darboe explained.
He said that after their conversation at his house “The only other time I saw him in my chambers is when he personally came with a motion to renew the partnership between Mr. Mamadi Baba Keita and Brian Peters.”
Under cross examination, Mr. Darboe said the visit of Mr. Peters was to change the deed between him and Mr. Mamadi Baba Keita, Susan Brown and was also seeking legal consultation on the issue. He further said that he could only give advice on the creation of new partnership but not on the same business, as it will result to conflict.
