Suspect Discharged

Wednesday, February 7, 2007
After spending almost 20 days in custody on suspicion of stealing a pedal bicycle, one Yankuba Dampha yesterday walked out of the Kanifing Magistrate’s Court freeman.

In what was described as a victory for justice, magistrate Pa Harry Jammeh yesterday discharged Dampha for a charge of stealing a pedal bicycle.

The bicycle, valued at D2, 000, was allegedly stolen by Dampha from the premises of the Gambia Teachers’ Union in Kanifing where he was providing security.

But to magistrate Pa Harry Jammeh, the continued detention of Dampha without producing him before the court of law was unconstitutional and that it violated his constitutionally guaranteed right.

PC 1781 Kinteh represented the Inspector of Police in the matter.
