In his judgement Senior Magistrate Mbackeh told the court that the prosecution had proven its case against the accused beyond reasonable doubt. He said there was inconsistency in the evidence of the accused person, adding that the accused had betrayed the trust bestowed on him by the complainant when the mobile phones were only entrusted to the accused.
In his plea of mitigation, the accused urged the court to temper justice with mercy.
Magistrate Mbackeh ordered the accused to pay to the complainant the sum of D5500 to cover the cost of the mobile phones. He also ordered the deportation of the convict after serving his sentence.
The prosecuting officer was Cpl 358 Sarr.
