Alleged Burglar Discharged

Magistrate George of the Bundung Magistrates’ Court on 22nd August 2009 acquitted and discharged one Gas Ley for the offence of housing breaking and stealing.

In delivering his judgement, Magistrate George stated that the accused was charged with the offence of house breaking and stealing to which he pleaded not guilty. He added that the prosecution in an effort to prove their case against the accused person called in only one witness and the accused also called in only one witness.

Magistrate George further stated that, the prosecution witness evidence was based on hear say evidence and that they have failed to prove their case against the accused person. He consequently acquitted and discharged the accused.
