In delivery the judgement, the Presiding Magistrate stated that, the convict was charged for stealing a radio, a charge he vehemently denied.

He added that in a bid to prove their case beyond any reasonable doubt, the prosecution had called in two witnesses, both of whom testified against the convict. He said the convict testified on his own and did not call any witness.

He further stated that after looking at the evidence of the prosecution witnesses and that of the convict, he was convinced that the convict had indeed committed the act.

The convict, in his plea of mitigation, said “I am begging the court to temper justice with mercy on me. Everybody is bound to make mistake and this was what happened to me. I am a family man and I left them in Guinean,” he told the court.
