According to the particulars of claim, on several occasions between August, 2007, and May 2008, the Plaintiff, at the instance of the defendant, supplied to the defendant juice, plastic cups, plastic spoons, tissue paper, toilet rolls, air freshener, tea, milk, coffee, napkins, toothpicks and other goods worth D278, 465 on short-term credit.

The claim further stated that the plaintiff and the defendant mutually agreed that payment for every supply shall be effected not later than two months after the defendant has taken delivery of the goods.

According to the claim, the plaintiff raised nine invoices in respect of the transactions and these invoices were endorsed by the plaintiff and the defendant’s employees.

The claim indicated that delivery notes were also endorsed by employees of the defendant whenever the plaintiff supplied the goods.

The last supply made by the plaintiff to the defendant on the 13thMay 2008, the claim further stated, became due for payment on the 13thJuly 2008 while previous supplies had matured for payment earlier.

The plaintiff claimed that despite repeated demands to the defendant and despite several assurances made to the plaintiff by one of the defendant company’s Director (Senior Thomas) the defendant has failed, refused and or neglected to pay for the said goods supplied to it by the plaintiff. The Plaintiff further claimed that he has suffered loss and damage.

The case was mentioned recently before Senior Magistrate Abdoulie Mbackeh of the Kanifing Magistrates’ Court.
