David Colley to answer to theft charges

Magistrate B Y Camara of the Banjul Magistrates’ Court, yesterday upheld the submission made by Inspector Touray, Prosecution Officer in the ongoing theft case against David Colley, former Director of Prisons, that he has a case to answer on the alleged theft charges levelled against him.

In his ruling, Magistrate Camara, said he has carefully looked and scrutinised the submission made by both the prosecution and the defence. He added that the prosecution bears the burden of proving his case beyond reasonable doubt in any criminal case.

According to him, the prosecution witness has clearly told the court that at the time the accused returned the said generator, it was not in its original condition.

He ruled that the testimony of the first prosecution witness was corroborated by the seventh prosecution witness. "Therefore, in my view, I believe that the accused has a case to answer," Magistrate Camara clearly stated.

It could be recalled that Mr Colley is standing trial for allegedly stealing a generator being the property of Old Jeshwang Prisons, valued at D35,000.
