Mr Fafa Kuyateh, the Brikama Area Council former Financial Controller, was yesterday, Tuesday, acquitted and discharged by senior magistrate, Edrissa M’bai, at the Brikama Magisrates' Court.
In his ruling on the case, magistrate Edrissa M’bai said that the counsel for the accused, Lamin Jorbateh, made a submission arguing that the plot of land for which the accused had been charged of obtaining by false pretence is in actual fact his, and tendered a document to buttress his point. He added that the Prosecutor neither responded to the submission nor produced in court any document for the said plot. In addition, he continued, after the testimony of all the prosecution witnesses, the prosecution failed to convince the court that the plot of land is the property of the complainant, Abdou Njie.
According to Magistrate M’bai, the court was not satisfied with the prosecution witnesses’ testimony. He therefore stated that the court is satisfied that the said land belongs to the accused and that he did not obtain any money by false pretence, adding that based on the facts, he would acquit and discharge the accused accordingly.
Speaking to this reporter shortly after his acquittal, Mr Kuyateh thanked the Almighty Allah for allowing the truth to prevail through the assistance of his solicitor Counsel Lamin Jorbateh.
Meanwhile, it would be recalled that Mr Kuyateh was standing trial for alleged illegal sale of land at the cost of D230,000.00 (Two hundred and thirty thousand dalasis) from one Abdou Njie.
