Lawyer Lamin K Mboge, defence counsel in the ongoing murder trial involving Demba Cham of Busumbala Village, on Monday gave his submission before Magistrate Ayoub John Njie of the Brikama Magistrates’ Court.

Demba Cham is alleged to have attempted to commit murder on August 1 2007, by hitting one Binta Njie on the forehead and holding her by the throat until she defecated.

In his submission, Lawyer Mboge challenged the testimony given by Jida Sonko, the  fourth prosecution witness, stating that she does not know anything about what happened between the accused and the complainant.

He asserted that the contradicting part of her testimony was that Mrs Sonko said that the accused is the husband of the complainant.

“Under cross-examination,” LK Mboge said, “Mrs Sonko has said that the complainant did not tell her where she defecated.”

He then submitted that the assertions made by the prosecution witnesses were insufficient to warrant a conviction of the accused.

He then urged the court to acquite and discharge the accused accordingly.
