‘Aggressive’ man convicted

Senior Magistrate Kumba Sillah-Camara of the Bundung Magistrates Court, on Tuesday, found one Alagie Mbaye of Abuko guilty of assault and causing bodily harm to one Modou Sarr.

According to the charge sheet, Alagie Mbaye unlawfully assaulted Modou Sarr on 2 August 2008 and hit him all over his body.

According to the police prosecutor, Corporal 134 Sambou, the complainant, who went to a shop to buy a bottle of soft drink had unintentionally hit the defendant while swinging his hand. Corporal Sambou added that the defendant confronted him over this action and he (the complainant) apologised. The defendant, according to the prosecutor, then insulted and knocked down the complainant.

The police prosecution revealed that it a soldier, while passing by, intervened and took the duo to the Banjulinding Police Station.

When the charge sheet was read, Alagie Mbaye pleaded guilty. He said “the complainant is a father to me and I know it was Satan who influenced me to have a problem with him.I am begging the court for mercy and forgiveness. I promise the court, it will never happen again.”

In her judgement, Senior Magistrate KS Camara sentenced the accused to a fine of D5,000, in default to serve a 1-year imprisonment term.
