Over 30 Workers Get Court Redress for non Payment of Dues

Thursday, October 11, 2007

Scores of labourers recently filed a civil suit at the Kanifing Magistrates’ Court against one Dawda Bojang, claiming an amount of D44, 350; a sum owed them by the defendant for failing to pay them for loading his consignment of timber for export to China.

The defendant accepted liability before Principal Magistrate Moses Richards of the Kanifing Magistrates’ Court. He however told the court that he did not know the actual amount the plaintiffs were claiming.

One of the plaintiffs, who acted as the spokesperson, revealed that they loaded 24 containers with timber for the defendant at D4, 500 per container, making a total of D108, 000.

Magistrate Richards told the plaintiffs that since the suit they filed against the defendant contained D44, 350 as their claim, he would enter judgement for the same sum in their favour. He eventually judged in the labourers’ favour and awarded them a cost of D1000.

He therefore advised the plaintiffs to file another suit against the defendant to recover the remaining balance of D63, 650. He finally told them that since the defendant has accepted liability, they should go and put their house in order.
