Lamin Jobarteh, one of the Defence Counsel in the ongoing NIA diamond saga, on Monday made a ‘no-case-to-answer’ submission, on behalf of his clients.
Appearing before Principal Magistrate Moses Richards of the Kanifing Magistrates’ Court, Counsel Jobarteh, submitted that “the case is so weak that no reasonable court can lend support for possible conviction of the accused persons”.
He further submitted that the exhibits of the prosecution are weak and they cannot be supported in anyway by the law. He added that Dodou Manneh, a prosecution witness who translated the German letter into English is not a credible and accurate person.
He also said that none of the commission members has been called to testify on the prepared report.
Counsel Jobarteh, said there is nothing before the court to show members of the commission that “they are dead, unwell, and unfit, physically or mentally to attend court”.
The six NIA officers, included Lamin Drammeh, Lamin Sanneh, Kajali Jawara, Fabakary Barrow, Salimina Drammeh and Basiru Jabang, all of whom are standing trial on charges of five counts, including theft.
