Magistrate Pa Harry Jammeh of the Kanifing Magistrates’ Court, on Tuesday, ordered Police Prosecutor 748 Mballow in the on-going D20, 000 theft case against Bala Nyassi, to produce Abdoulie Kujabi, former NIA Director General and other witnesses, on March 26, to enable him to expedite the case.
However, the case could not resume on Monday, because the presiding magistrate was not able to attend.
Magistrate Jammeh’s order came about following the testimony of Wulinding Sanneh, who told the court that he had reported to Abdoulie Kujabi (when he was Director General of NIA), about the accuser’s claim that he was robbed by the rebels in Casamance. However, Bala Nyassi denied ever informing the prosecution witness about any robbery by the rebels.
During the last sitting, Wulinding Sanneh, a driver at the Kanilai Farm, told the court that Bala Nyassi was a former employee of the farm. He said the accused was responsible for the distribution of goods to the Kanilai Farm’s clients in Dakar and Guinea Bissau.
He said the accused had reported to have had a road accident, upon his return from a trip to Guinea Bissau. He added that Mr. Nyassi again, informed them that he was robbed by rebels in Casamance, during a second trip to transport the goods to Guinea Bissau. According to him, the accused immediately reported the matter to his former boss, Abdoulie Kujabi.
However, he pointed out that he cannot recall the amount of money Mr. Nyassi deposited to the farm, upon his return from Guinea Bissau.
Mr. Sanneh informed the court that he had made a statement on the case at the Serious Crime Unit of the Gambia Police Headquaters, adding that he cannot recognise the statement in question, because he is not educated. However, he did identify the statement he claimed to have thumb printed.
During cross-examination, the accused put it to the witness that upon his return from Guinea Bissau, he (Nyassi) gave the witness CFA40, 000, adding that it was Wulinding, who used to accompany him to change the CFA into Dalasi. He then denied ever telling Mr Sanneh that he was robbed by the rebels in Casamance.
