In Court Martial Counsel filed ‘no case to answer’

Emmanuel Fagbenle, Director of Public Prosecution (DPP), yesterday informed the general members of the Court Martial that he had received a file on ‘no case to answer’ submitted by Mrs. Neneh Cham-Chogan, counsel for Private Alagie Nying who is facing criminal charges of treason, a case filed in by the State against ten officers of the Gambia Armed Forces (GAF) on February 15, 2007.

Mrs. Neneh Cham-Chogan, responding to the DPP’s comments said, the late submission of her address to the DPP was due to her a week and half long travelled to Basse, Upper River Region (URR) for the opening of a new High Court

Justice Akomaye Agim, the presiding Judge of the Court Martial told the DPP Fagbenle to prepare his response to the ‘no case to answer’ submitted file by the defence counsel, Neneh Cham- Chongan and submit it on or before Monday, February 19, to enable him deliver his ruling on the ‘no case to answer’ submitted file by Thursday, February 22.

However, the proceedings of the Court Martial could not continued further as defence counsel Lamin Camara, who represented Captain Pierre Mendy, the sixth accused person was said to beareved. Lamin Jobarteh, counsel for Captain Wassa Camara, informed the court that it would be risky for him to proceed with the case as Lawyer Camara is yet to complete his case.

Justice Agim then adjourned the case to Saturday February 17. He took the opportunity to convey his condolence to counsel Camara and his family over the lost of their beloved relative. He also commended the defence counsel over what he called their spirit of co-operation and urged them to maintain such for the rest of the trial.
