In Dodou Kassa’s trial Magistrate to rule on no case submission

Magistrate Abdoulie Mbackeh of the Kanifing Magistrate Court is expected to make a ruling on no case to answer the submission made by Lamin Camara counsel for Dodou Kassa Jatta and his co-accused, on April 30, 2007.

This verdict came after the defence counsel’s no case to answer submission before the court, for Dodou Kassa Jatta and his co-accused. Magistrate Mbackeh asked for both the prosecution and the defence to give him a week to carefully look at the facts before he delivered the ruling in respect to the no case submission made by the defence counsel.

The prosecution has called nine witnesses. Lamin S. Camara, the defence counsel in his no case submission, told the court that the prosecution have not made any prima facie case against the accused persons, noting that the evidence before the court did not prove any of the elements of the offenses that the accused persons were charged with.

He added that it is right law that if the prosecution fails to prove even one of the charges, then a no case submission should be upheld. Lawyer Camara told the court that there was inconsistency in the testimonies of prosecution witnesses 1, 2, 8 and 9 and that of 5, 6 and 7. He finally urged the court to uphold his submission.
