According to the consent terms, the parties had agreed on the following terms, which would form the basis of the judgement of the court:
1.Liability is admitted
2.Judgement be entered in favour of the Plaintiff for 20,000 Euros plus filing and service fee.
3.The Plaintiff’s claim of 20,000 Euros shall be liquidated as follows:
(a)The
defendant pay the plaintiff the sum of 10,000 Euros and/or his legal
practitioner on or before
(b)The defendant shall pay 2,500 Euros to the plaintiff and/or his legal practitioner on the 15thday of the following months until the entire judgement amount is settled.
(c)Provided that if the defendant, according to the consent terms, defaults in the payment of any installment, the entire outstanding balance shall become due and payable forth with.
Senior Magistrate Abdoulie Mbackeh, who was presiding over the case, made his judgement based on the consent terms between the parties.
