Appeal Court to rule on Carnegie case

Three judges of the Gambia Court of Appeal are expected to rule on the stay-of-proceedings in the Carnegie Minerals case, on July 17.

Justice Akomaye Agim, the president of the Appeal Court, made this announcement yesterday, following submissions and counter-submissions by both the state prosecutor, Emmanuel Fagbenle and Defence Counsel Mene.

When the matter resumed, Fagbenle, who is the director of Public Prosecution, expressed his intention to rely on the motion of 30th May 2008, to support his case. Fagbenle urged the court to grant the “prayers of his motion”.

Responding to the DPP’s submissions, Lawyer Mene argued that the DPP’s application lacks merits. Lawyer Mene also expressed his intention to rely on the motion and all the paragraphs contained in his affidavit, as well the two exhibits attached with. He urged the court to dismiss the application in order to allow the proceedings at the High Court to continue.
