Woman convicted

Ndey Njie, was on Thursday convicted and sentence to a fine of D12,000 in default to serve 12 months in jail by Principal Magistrate BY  Camara of  the Banjul  Magistrates’ Court. 

The conviction and sentencing of the former minister’s wife came after she was found guilty of common assault charges contrary to the Criminal Code, Laws of The Gambia.
According to the particulars of the offence, Mrs Ndey Njie on May 14th 2007 at the Banjul Police Headquaters slapped one Nyara Adams thereby committing an offence.

Handing down his verdict, Principal Magistrate Camara noted that both the Prosecution and the Defence called witnesses who gave evidence on the case. The Prosecution according to him, called five witnesses most of whom are senior police officers of The Gambia Police Force. He added that the court found their evidence credible, and that the Prosecution has proven their case beyond all reasonable doubt against the accused, Ndey Njie. "Therefore the court found the accused guilty of the offence and she is accordingly convicted,” the magistrate said. 

Magistrate  B Y Camera described the behaviour of the accused as a total lack of discipline, respect for the law and public moral. He said that nobody is above the law, adding that offenders most be punished. He further described  the accused person’s behaviour as stupid considering the circumstances under which the offence was committed at the Police Headquaters.

Haddy Dandeh Njie, Counsel for the accused in her plea of mitigation, implored the court not  to pass a custodial sentence on the accused, saying that the accused is a young lady. She added that the accused also has a child of 12 years whom she is taking care of.

Lawyer Dandeh Njie said sentencing the accused person would have irreparable consequences on the growth of the  child  and  the accused’s life. She added that the accused is a first offender saying that the case has caused her extreme embarrassment
Acknowledging the tireless efforts of the Defence Counsel, Magistrate Camara then sentenced the accused to a fine of D7,000 and a D5,000 compensation to the complainant, in default to serve 12 months in jail.
