Defense Urges Court to Enter No Case

The defense counsel, Lawyer Sheriff Tambedou, yesterday told the court that the prosecution had failed to prove a prima-facie case against his client, Omar Ndow.

Making reference to points of law to advance the defence’s stance on the prosecution’s submission, Counsel Tambedou argued that the prosecution did not obtain the consent (fiat) of the Attorney General as required by law. He therefore urged the court to disregard the letter tendered by the prosecution, maintaining that it was not properly brought before the court.

Lawyer Tambedou further submitted that a company could be sued in criminal matter contrary to the prosecution’s assertion that a company could only be sued in a civil matter. With regard to the defence’s silence on the consent of fiat at the commencement of the case, the defense counsel responded that such consent was not for the defence to raise but it is for the prosecution to obtain the consent from the Attorney General as required by law.

In conclusion he maintained that his client had no case to answer and urged the court to acquit and discharge him accordingly.
