Senior Magistrate Kayode Olajubutu of the Banjul Magistrates Court is expected to deliver a ruling today on the no-case submission made by Lawyer Edrissa Sisoho, counsel for Ebrima Secka and Alieu Jagne.
Ebrima Secka and Alieu Jagne are standing trial for alleged criminal trespass and for behaving as rogues and vagabonds.
The ruling is preceded by arguments from both the prosecution and the defence on whether the accused persons have a case to answer.
In his submission during the last sitting of the case, Lawyer Sisoho argued that the mere fact that the accused entered the premises of the Gambia Senior Secondary School (GSSS) and took photographs “does not make their entry illegal”, adding that “nothing illegal transpired”.
He further submitted that entering into the premesis of GSSS had been tolerated for a long time.
He therefore, said that the prosecution had failed to make a prima facie case that would warrant the accused persons to open their defence.
Corporal Sanyang, who is the prosecution officer, also argued that entering into the premises of the school without permission caused annoyance to the staff and authorities of the school.
He then referred the court to Section 167 of the Criminal Procedure Code to back his counter-submission.
