Justice Akomaye Agim, presiding judge at the ongoing Court Martial at the Yundum Military Barracks, on Thursday ruled that counsel who intends to file in “a no case to answer submission” for their clients are welcomed to do so by February 8.
Justice Agim made this ruling during a sitting on Thursday, following the Defense Counsel, Neneh Cham-Chongan’s intent to file “a no case to answer submission” against her client, Private Alagie Nying.
The Defence Counsel Cham said her client, who was facing the Court Martial for his alleged involvement in the March 21, 2006 foiled coup against the democratically elected government of President Yahya Jammeh, has “no case to answer”.
Meanwhile Borry Touray, Counsel for Cpt Yahya Darboe, second accused person, told the court that thieves have last week broke into Mrs Sainabou Wadda Ceesay’s car, his co-defence counsel and stole bags containing case files of information retrieved from their client.
Counsel Touray added that, it would be difficult for them to continue on the proceedings of the case, without those files. He appealed to court to supply them with copies of relevant files and some information.
Justice Akomaye Agim, then lamented the lost of Defense Counsel’s case files. He assured them that the court will provide them with the copies of the files and information necessary to enable them continue on the case.
