Senior Magistrate EF Mbai of the Brikama Magistrates’ Court on Monday sentenced one Nuha Jammeh of Makumbaya Village, Kombo North to a D1000 fine, in default to serve six months in jail.
Mr Jammeh was found guilty of unlawfully and wilfully assaulting one Kebba A Jammeh.
Handing down his verdict on the case, Magistrate M’bai said the accused intentionally slapped the complainant, an act which was clearly premeditated. Senior Magistrate EF Mbai also said he was satisfied that all the prosecution witnesses were credible and trustworthy. He maintained that the evidence presented by the prosecution witnesses are reliable and consistent.
However, Lamin Camara, counsel for the accused argued that his client be discharged and acquitted. He added that the prosecution has not proven its case beyond all reasonable doubts. Lawyer Camara further went on to declare that there had been so many inconsistencies with regards to the evidence of the prosecution witnesses.
Despite the argument of the defence counsel, Senior Magistrate EF Mbai sentenced Nuha Jammeh to a fine of D1000, in default to serve 6 months. He also ordered that the complainant, Kebba A Jammeh be compensated with D1000, in default to serve another six months.
He ruled that both sentences will run consecutively.
