Kemo Sarjo and Ebrima Bah, first and second accused persons, were on Tuesday arraigned before Senior Magistrate EF M’bai of the Brikama Magistrates’ Court on two counts; that of felony and stealing, contrary to the Criminal Code, Laws of The Gambia.
The particulars of the offence on count one stated that, the two accused persons on 22nd September, 2007, at Amdalai village, Kombo East, conspired to commit felony by stealing.
Count two also stated that the two on the same day at Barakisa in the Cassamance region of the Republic of Senegal, stole two cows valued at D16,000 being the property of one Abdoulie Kujabi. When the charges were read to them, they both pleaded not guilty.
Lawyer Ousainou Darboe, defence counsel for the accused persons, applied for the court to str out the charges on count two stating that the place where the offence was committed is not in the jurisdiction of The Gambia.
Magistrate M’bai then granted the application while he subsequently adjourned the proceedings on count one to December 5th for continuation.
