Justice Nguie Mboob-Janneh of Brikama High Court, recently acquitted and discharged Lamin Jarju, who had been facing trial for impersonation charges brought against him by the state, in 2007.
Justice Mboob-Janneh also overruled an earlier decision by Magistrate Edrisa Fafa Mbai of Brikama Magistrates’ Court, on October 9 2007, that the appeallent (Lamin Jarju) had a case to answer. It could be recalled that Magistrate Mbai made that ruling following the no-case-to-answer submission by Lawyer Borry Touray, on behalf of his client.
The Brikama High Court Judge argued that the magistrate should have upheld the no case submission since the prosecution had failed at the end to establish the offense against the accused person.
