Over D161,000 claim suit in court

Govinda and Sons Limited, a construction company, has filed a legal suit against Emmanuel Charles Quist, claiming the sum of D161,201 plus cost of D5,000 with interest.

When the case was called on Friday before Senior Magistrate Abdoulie Mbackeh of the Kanifing Magistrates’ Court, Emmanuel Charles Quist denied liability. Presiding Magistrate Mbackeh then adjourned the case to the 4th December, 2007, when full hearing shall commence.

Counsel Haddy Dandeh-Njie represented Govinda and Son Limited in the trial.

According to the particulars of the claim, of all material times, Govinda and Sons Limited, the plaintiff, carried on business as a building contractor, and the defendant, Emmanuel Charles Quist was the owner of property situated at Brusibi in Kombo North. By an agreement in writing, Govinda and Sons Limited, agreed with Emmanuel Charles Quist to construct and hand over keys.

Govinda and Sons Limited has made several demands for the payment of their money but to no avail.

In a similar development, one Binta Jaiteh has admitted liability to the sum of D125,000 including cost to the same company. These are monies she owed to the company for the construction of a dwelling house for her.

She told the court that she would pay the amount on or about the 27th November, 2007.
