Briton Seeks Court Redress to Alleged Breach of Contract

Lyn Goldsmith, a Briton, dragged one Lamin Ceesay to court for allegedly failing to repair the engine of his Nissan Vanette, after paying him upfront for the service. The plaintiff testified on 24th May, 2007, before Magistrate Jammeh of the Kanifing Magistrate Jammeh of the Kanifing Magistrates’ Court.

In his testimony, Mr Goldsmith told the court that he lives at Kerr Serign. He adduced that on the second week of May, 2006, he took a Nissan Vanette minibus to the defendant for him to repair the engine. He said he made successive payments to the defendant in the amounts of D25,000, D5000, D5000 and D1000.

He further stated that he had bought the vehicle for 2,000 pounds sterling, adding that he had since taken the vehicle for panel beating and spraying with different mechanics.

He claimed that the defendant did not repair the engine of the vehicle, saying that the vehicle was no longer at the defendant’s garage. He said some mechanics had evaluated the vehicle and valued it at D65,000, adding that it is now beyond repair.

However in his response the defendant denied receiving the monies the plaintiff claimed to have paid to him.

He said he only received D13,500 from the plaintiff for the repair of the car and had since paid back D10,000.

The defendant, Mr. Ceesay, was ordered by the court to pay the balance of the conceded amount (D3,500) before the adjourned date, 6th June, 2007.
