Principal Magistrate Moses Richards of the Kanifing Magistrates Court on Tuesday, acquitted Mustapha Leigh, former Director of Technical Services, Department of State for Works, Construction and Infrastructure and Momodou Lamin Sonko, Proprietor of Boto Construction Company.

This verdict came after the Police Prosecutor, Assistant Superintendent Bojang applied to the court to acquit the accused persons. He told the court that, investigations are still going on, saying “ Your worship I am yet to lay hands on the file and therefore I would like to withdraw the case, under 68 subsection 1 of the Criminal Code to allow the investigators to finalise their investigation’.

Lawyer Antuman Gaye, Counsel for the second accused, said his only concern is whether the accused will be subjected to further detention.

Then Magistrate Richards subsequently granted the application made by the prosecution.

It could be recalled that, the duo were charged for abuse of office and stealing a bulldozer, being the property of The Gambia government.
