Principal Magistrate Kebba Sanyang of the Kanifing Magistrates’ Courts, has overruled an application by Defence Counsel Lamin S Camara, for the court to discharge his client, Lamin Fatty of The Independent newspaper.
Lamin Fatty, a reporter for The Independent newspaper, has been standing trial on charges of publishing false information, contrary to the Laws of The Gambia.
In his application before Principal Magistrate Sanyang, Counsel Camara argued that the case has been dragging for sometime without due proceedings. According to him, the matter has also been adjourned on several occasions at the instances of the prosecution, saying “your worship, justice delayed is justice denied”.
He held that the procrastination of the trial has a negative impact on the rights of his client, Lamin Fatty.
Principal Magistrate Sanyang, overruled the application, saying the Prosecutor still needs to be given time to proceed on the case. He therefore, adjourned the case to November 20th.
Meanwhile, Police Prosecutor 1748 Mballow is said to be at a training programme.
However, the Prosecutor is expected to call its third witness, Malamin Sanneh, Officer Commanding Major Crimes Unit of the GPF, who was said to be out of the jurisdiction.
