The Kanifing Magistrates’ Court, presided over by Principal Magistrate Moses Richards, yesterday September 20th, issued an order for Seedy Njie, the purported guardian of Basiru Jammeh, defendant to appear in court on September 24, 2007 to clarify doubts surrounding the land dispute between Basir Jammeh and one Musa Joof, the Plaintiff
Musa Joof is claiming possession of land the defendant Basiru Jammeh is occupying. He is also seeking permanent injunction and D50,000 for damage to the land as compensation.
The summon order followed the defendant’s total denial of the evidence given by the plaintiff describing it as untrue and baseless. The presiding magistrate said that Seedy Njie must either appear, send his children to appear on his behalf or the court would move to Tujereng.
“The courts do move whenever the need arises,” said Magistrate Richards.
He emphasized that the court has no interest in the case, adding, “All what the court wants is to mediate between the parties and arrive at justice. It is the duty of the court to adjudicate justice on the matter before the court”. The case was then adjourned.
