In Makumbaya assault trial Defence counsel ends submission

The defence counsel in the ongoing Makumbaya assault trial, Lawyer Camara, defence counsel has ended his submission before the Brikama Magistrates’ Court, presided over by Magistrate EF M’bai.
 
Nuha Jammeh, a resident of Makumbaya village, was accused of having slapped one Kebba Ansu Jammeh in the face. The incident occurred last Tuesday, during a land dispute at Makumbaya. In his submission, Lawyer Camara reminded the court that the prosecution needs to prove all their facts beyond reasonable doubt indicating that this is required because the prosecution has not proven any of the ingredients in the charge.  Lawyer Camara then recalled that the prosecution has called on three prosecution witnesses in the case and all their testimonies were inconsistent.

He said the first prosecution witness was Kebba Ansu Jammeh (the complainant, who in his testimony told the court that the reason why the accused person slapped him was because he was told by one Samsidin Jammeh to procure him a customer for the sale of a portion of his land. 

“Mr Jammeh told the court that when he said this the accused slapped him” Lawyer Camara said.

He went on to say that the second prosecution witness was Landing Jammeh, who stated that he was present during the dispute, but was not concentrating when the accused slapped the complainant.

He finally submitted that the third prosecution witness, Pa Ebrima Colley, said that the reason the accused had slapped the complainant was that the accused said something and the complainant said, “No, that is not true”.

At this juncture, Lawyer Camara said that the evidence of all the three witnesses was inconsistent. The case was then adjourned to Wednesday, October 3rd. Police Prosecutor 413 Sanyang stood in for the IGP.
