Thursday, October 4, 2007

Magistrate EF M’bai of the Brikama Magistrates’ Court, on Tuesday acquitted and discharged Mustapha Touray and eight other youths, who were standing trial for trespass at the Banjul International  Airport.

Handing down his verdict, Magistrate M’bai told the court that the prosecution has called on four witnesses.

He added that the evidence of the prosecution witnesses were inconsistent with the preferred charges against the accused persons, because the prosecution has alleged that the accused persons, particularly Mustapha Touray, the first accused person has stolen a bag belonging to a newly arrived passenger.

Magistrate M’bai noted that since the beginning of the case, the complainant has never been brought to court for testimony. He said that the prosecution has not proven its case beyond reasonable doubt.

He accordingly acquitted and discharged all the accused persons and warned them to refrain from such act.
