The Director of Public Prosecution, Emmanuel Fagbenle, disclosed to the High Court yesterday that the state had filed an appeal against the ruling on Ousman Jatta (alias Rambo) and Kanyiba Kanyi.
The DPP informed the High Court before Justice Monageng that after the ruling of the court on 5th June 2007, they had reason to discuss with the police and the National Intelligence Agency (NIA), adding that the position still remained the same. He said there was no other option but to file an appeal against the decision of the court.
The DPP further noted that the state had also filed a motion for the stay of enforcing the order of the court. He further applied for an adjournment so that he could get in touch with the Attorney-General who he said was out of the jurisdiction.
Lawyer Ousainou Darboe, the defence counsel, said that he was served with the application in court. He added that he would have to react to the application though he would not make any comment then. He emphasised his knowledge that his clients were in the custody of the applicants. He revealed to the court that Ousman Jatta sent him a note through his (Jatta’s) wife from Sarangai in the Upper River Region.
The applicants, Ousman Jatta and Kanyiba Kanyi, are believed to be under detention in various places since their arrest in September 2006.
