Senegalese Customs officers’ case set for judgement

Five Senegalese Customs Officers who are standing trial on charges for being in possession of fire arms and illegal entry into the territorial waters of The Gambia before Magistrate Pa Harry Jammeh, is set for judgment on May 7, 2007.

This development came when Antouman Gaye, the Defence Counsel, told the court that he had filed two applications in connection with the case at the High Court in Banjul. One application was regarding whether the Kanifing Magistrates’s Court can hear the case and the other application regarding the bail.

“I am respectfully applying in the interest of justice, for the court to adjourn the case and wait for the out come of the High Court, whether this court can hear this matter,” he said.
In reply, Ms Wood, the state counsel, told the court that the accused persons are still in detention because they were not able to fulfil their earlier bail conditions.

She added that the applications the defence is talking about are yet to be filed.
“All the evidence has been taking long so I would urge my learned friend to address the court,” she said.
Magistrate Pa Harry Jammeh, in his ruling, said the fact that there is an application at the High Court with regards to this matter it won’t delay the case.  He told the defence to proceed with the case.

The Defence Counsel Gaye then told the court to use its discretion to decide what to do. Magistrate Pa Harry Jammeh then adjourned the case until Monday, May 7, 2007 for judgment.
