In court martial Ultimatum for DPP

Justice Akomaye Agim, presiding judge at the on-going Court Martial at Yundum Military Barrack, yesterday gave a 7-day ultimatum for the Director of Public Prosecution (DPP), Emmanuel Fegbenle to deliver his address in the court.

Agim’s ultimatum follows DPP Emmanuel Fegbenle’s submission to be given ample time by the court to enable him preparing his address. According to him, the nature of the case required him to be given an ample time to prepare for his address since he is dealing with 10 accused persons.

Justice Akomaye Agim, said the State has clossed its case against the 10 officers of the Gambia Armed Forces (GAF), in connection with March 21st 2006, foiled coup plot. He said regulations guiding the proceedings of general Court Martial states that whereas the accused person or persons did not call in any witness in the case, the prosecution should address the court, but on the other hand, where the accused person or persons call in witness/s in the case, it is for the defence counsel to address the court. He therefore granted the state prosecutor to prepare and submit his address within 7 days. Justice Akomaye Agim, at this juncture adjourned the case to 15th March 2006.
