Student cleared of deception charges

Tuesday, November 27, 2007

Senior Magistrate EF M’Bai of the Brikama Magistrates’ Court, on Tuesday, acquitted and discharged one Lamin Mboge Sowe, a student at Farato village, Kombo North.

Mr Sowe was standing trial on charges of giving out false information to one Corporal Saho, a public officer.
Sowe was claiming D3,450 from Karl Heinz Kloss, a Dutch national for a breach of contract on an agreement to pay his one year tuition fee. Sowe was also claiming £380, equivalent to D20,900 for the cost of his air ticket to UK, £85 for the cost of a student visa application.

In his judgement, Senior Magistrate M’bai recalled that he was not satisfied with the prosecution evidence because it did not prove its case beyond reasonable doubts. He noted that since the commencement of the trial, Corporal Saho (whom Mr Sowe was said to have given the false information to) never appeared before the court to give his testimony.

Magistrate M'bai therefore acquitted and discharged Lamin Mboge Sowe accordingly.
