One Yunusa Ceesay has filed a legal suit against Lawyer Gomez, seeking the recovery of the sum of D90, 000 being the balance of money allegedly owed him by the defendant, Lawyer Gomez. The case was presided over by senior magistrate Abdoulie Mbackeh of the Kanifing Magistrates’ Court.
The plaintiff claimed that he had been a farmer resident in Jambanjelly in Kombo South district “at all material times.” He further indicated in his claim that in or about 2006, he entered a land transaction with one Mustapha Barrow who agreed to sell a piece of land to him at the price of D160, 000. He stated that he was with his cousin, one Isatou Cham at the time of the transaction.
He further adduced that he paid to the said Mustapha Barrow D110, 000, leaving a balance of D50, 000 which was to be paid on the completion of the sales transaction.
He claimed that the said Mustapha Barrow failed to complete the sales transaction whereupon he began the process of recovering the sum he had paid, adding that Lawyer Gomez had stood as a guarantor after making an undertaking.
Lawyer Gomez was not present at the time the case was mentioned as he had earlier written to the court that he was not well.
The court clerk informed the court that he had verbally notified Lawyer Gomez that the case was coming up on 7th November, 2007. Lawyer Darboe, who represented the plaintiff, asked the court to award his client D1000 cost because of Lawyer Gomez’s absence.
Magistrate Mbackeh however awarded the plaintiff D200 as cost and adjourned the case to 21st November, 2007 for continuation.
