Alhagie Malick Samba, a resident of Wellingara, Sales Manager of Gampark, and a brother of Tabara Samba, who is currently standing trial on charges of allegedly killing her husband, Ebrima Nyan, by pouring hot oil on him while sleeping on Thursday, testified before Magistrate Pa Harry Jammeh of the Kanifing Magistrates’ Court.
In his testimony, Mr Samba who was crying when called to testify, told the court that he shared the same father and mother with Tabara Samba, the accused.
He told the court that, he knows the deceased Ebrima Nyan and that they were friends since 2004. He further testified that, Ebrima Nyan later expressed his desire to marry her sister, Tabara Samba.
He said he informed Tabara Samba about Ebrima Nyan’s proposal of marrying her and she responded positively to the proposal. Mr Samba added that, he also informed their parents in Senegal, who gave him the green light to tie the knots between the two.
The witness further described the marriage between the two as peaceful. “Even one day, Tabara told me that her marriage with Ebrima Nyan was the best and that she lovedhim very much” he told the court. He added that he used to visit both Tabara Samba and the late Ebrima Nyan at their house during weekends, together with his children. “After the incident, I also visited the late Ebrima Nyan twice at his hospital bed and he usually told me that my sister, Tabara Samba poured the boiled oil on him” he said.
He described the incident as an accident and said he would not consider her sister as a bad woman.
During cross examination by Police Prosecutor, Commissioner Burama Dibba, Alhagie Malick Samba admitted in the court that he could remember a day when the two had a problem in their house in his presence. “But, I later solved the problem” he responded.
The Defence Counsel then applied for Dr Ceesay of the RVTH to be recalled and also informed the court that they have a witness who is a burn specialist and is likely to testify. The case continues on Tuesday, 2007.
