As Kanilai Farms, Dutch National’s Case Drags

The long-drawn out litigation involving the Kanilai Family Farms and a Dutch national has once again suffered a setback and the presiding magistrate was so disenchanted by the snail’s pace progress of the case that he warned to strike it out if the status quo persists.
br/> Mike Berber was accused of stealing three generators from Kanilai Family Farms Ltd. and Buyine village sometime in 2006 but since his case was mentioned on 7 February 2007, the prosecution could not produce any witness to prove the ingredients of their case beyond reasonable doubt.
br/> On resumption of the case last Thursday, the prosecution officer, ASP Badjie, was once again absent from the court, though the accused was in.
br/> In his reaction to officer Badjie’s absence from court, magistrate E.F. Mbai said it was frustrating that this particular case has been dragging since February without the prosecution producing any witness. He vowed to strike out the case and discharge the accused if the prosecution fails to turn up on the next adjourned date.
