Magistrate Martin Disenchanted

Magistrate Assan Martin was yesterday in no mood to entertain any delay in the protracted trial of UDP’s Lamin R. Darboe over charges of assault.

The magistrate was poised to strike out the case at the next adjourned date if the prosecution fails to appear for proceedings. On the other hand, magistrate Martin would notwithstanding proceed with the case if the accused fails to appear for the trial whilst the prosecution was present.

The magistrate made these resolutions yesterday when on the resumption of the case the court was informed that neither the counsel for the accused nor the prosecutor was present in court.

ASP Badjie, holding brief for 413 Sanyang, informed the court that Sanyang has been transferred to another duty station.

For Lamin R. Darboe, the case could have proceeded even without the presence of his counsel but the case was adjourned to 2 May 2007.
